TERMS OF SERVICE

By using our website, our service, and/or buying our products, you agree to this User Agreement.

You agree to comply with all local, state, national, and international laws, especially regarding copyright and trademark law. If you knowingly or unknowingly break the law by uploading images or digital content to the website without the express written permission of the content owner, you accept all liability for doing so, and agree to hold harmless Gameshirtz.com, it’s owners, employees, associates, vendors, designees, and assigns, and to assume all liability for your behavior or any subsequent behavior of anyone connected with Gameshirtz.com as it relates to the content in question. You may also be liable to civil or criminal prosecution, and Gameshirtz.com will willingly cooperate with any efforts to prosecute you if you break the law. Gameshirtz.com respects the rights of hardworking content creators, licensees, and distributors, and you should too.

Gameshirtz.com has licensing relationships with certain game companies and other intellectual property owners. The games for which we have licenses are listed on our product and ordering pages. Our licenses allow you to capture images from those licensed games, upload them here, and buy products from us containing those licensed images. You then own the product but you may not own the image and you certainly do not own the right to reproduce that image elsewhere, for personal or any other use. For other information, you should refer to the user agreement and terms of conditions for the game you have questions about. Those user agreements, terms and conditions, and other agreements supersede any information you find here.

If you are the content owner, by uploading content to us you grant us a limited license to store the content for the purpose of providing our services and products to you in the manner to which you direct us (for example, when you direct us to print several T-shirts and ship them to addreesses you specify). You do not grant to us any ownership rights, distribution rights, licensing rights, or other rights beyond those limited rights to serve your needs as you direct. We will take commercially reasonable precautions to safeguard the content and we do not store your content longer than reasonably necessary to provide you with quality service during our reasonable expectation of a business relationship, but we cannot guarantee absolutely the security of your content. Even the most secure systems are sometimes compromised, even military or hospital systems. We cannot be held liable for damages of any kind resulting from the loss, damage, or theft of your uploaded content. When we are done with your content we will delete it, not return it to you. If you have concerns about the safety of your content, do not upload it to us.

RESTRICTIONS

We reserve the right, in our sole discretion, to refuse to print any image or content. We will not print strongly obscene, deeply offensive, or otherwise objectionable content. We like to have fun and obviously we do have a sense of humor. We seek to serve our customers, listen to your needs and desires, and provide products and services that make you happy. However we are not required or obligated to print anything that we don’t want to. Our guidelines are internal, confidential, and may change from time to time or even be inconsistently applied, but it boils down to common sense. Basically if you’re thinking “this crosses the line. They probably won’t print this.” Don’t upload it. You’re probably right.

In the event that we decide to reject your image, we will refund all your money including Shipping & Handling. However, repeat offenders should be aware that if a customer repeatedly uploads images we feel we must reject, we reserve the right to start charging a “hassle fee” to that customer after the third rejected image. This may apply even if the customer uses different login accounts. The amount of the hassle fee will be what we, in our sole discretion, determine to be a reasonable amount to compensate us for the staff time required to review & reject, and process the files and accounts created or uploaded by the repeatedly rejected upload offender.

LIABILITY

You assume all liability for your actions. Don’t upload stuff you shouldn’t. If it somehow escapes our censors and gets printed, it’s your fault, not ours. Don’t make us hurt you.

If you upload copyrighted images for which you do not own the rights, you bear all the responsibility as stated elsewhere in this agreement. We won’t help you. We will hang you out to dry.

Be cool. If you created something awesome, like a book or a game or a movie, and you were trying to figure out how to get paid for your work, and then someone came to your house and stole it, and started selling it, living off your work and not giving you a dime, how would you feel? Pretty pissed off I bet. Think about it.

This page and this User Agreement may change from time to time without notice. You should check back from time to time to see how this user agreement has changed. If you have any concerns about your rights and responsibilities please contact us. Your continued use of this website, it’s products or services after any changes to this user agreement constitutes your acceptance of those changes and this entire User Agreement.
